Alabama Bingo Trial Still Lingering On
The on going Alabama vote buying trial looks like it may well be over soon. Jurors in the case have retired to deliberate the evidence but were a little anxious about what they have to decide. The jury sent a note to the judge to say that some charges they had to decide upon were already sorted out in their eyes, they feared that they would not be unanimous in the decision about the others.
The judge approached all the attorneys in the case and a decision was made to send the jury back into deliberations to see if they could not come up with a satisfactory outcome. One of the attorneys in the case commented that it was in everyone’s interest to let the jury decide on the outcome and this is what they have been asked to do.
There are thirty seven charges in all and they have now been out for five full days but still no positive results yet. The attorneys defending their clients have started to discuss whether their own client has been acquitted in the case but this would mean given a partial verdict only. This is something that the court does not really want to get into at this stage.
It would seem then that this jury may end up hung and the judge would then have to decide whether he would accept verdicts on only some of the charges and declare a mistrial on all the others. It is hard to see where this case is going at the moment since no one knows how many of the charges have been decided upon and in whose favour.
If this happens the judge may well then ask the prosecutor if he wants to retry those cases that could not be decided upon. This may well involve all the defendants in the case and this would cost the country an inordinate amount of cash to start the whole thing all over again.
One would expect that the judge will only make this decision once he knows which verdicts the jury has come up with and how many charges and defendants are involved. It is obvious that if some of the more prominent defendants are guilty as charged, an appeal process will be launched. One suspects that this case is nowhere near coming to a satisfactory conclusion just yet. The trial continues with baited breath!
